Terms of Service
These terms apply to game source codes, custom development and other services provided by Shivom (“we”, “us”) through shivom.xyz. The quote or invoice we send you for a specific project forms part of these terms, and if it says something different, the quote or invoice applies.
1. Quotes and scope
Every project starts with a written quote that states the scope, price, delivery date and payment schedule. Work outside that scope is quoted separately and only starts once you agree. A quote stays valid for 14 days unless it says otherwise.
2. Payment
Most projects are paid in milestones: a deposit to start, then the remainder as builds are delivered. Ready-made source codes are paid in full before delivery. Delivery of final files and transfer of rights happen once payment is complete.
3. Ownership and licence
- Custom work. Once you have paid in full, you own the code and project files we write specifically for you, as described in your quote.
- Ready-made source codes. You receive a licence to use, modify and publish the game in your own apps and under your own brand. Unless your invoice says otherwise, you may not resell or redistribute the source code itself as a standalone product.
- Our tools. We keep ownership of our general-purpose libraries, tools and know-how, and give you a licence to use them inside your delivered project.
- Third-party assets. Engines, plugins, fonts, sounds and art made by others keep their own licences, which we will list where they apply.
4. Your materials
You confirm that you have the right to give us any text, images, code or other materials you supply, and that using them as agreed does not infringe anyone else’s rights.
5. Revisions and support
Each quote states how many rounds of revisions are included. After delivery we fix defects in the delivered work, at no charge, for 30 days. Support after that, and new features, are quoted separately.
6. Refunds
Because source code and project files are digital goods that cannot be returned, payments for delivered work are non-refundable. If we cannot deliver what the quote describes, we will fix it or refund the part of the payment for the undelivered work. Cancelling before work begins returns the deposit, less any costs already incurred.
7. Platform rules
You are responsible for following the rules and policies of the app stores and platforms you publish on. We build to current platform guidelines but cannot guarantee approval of any submission.
8. Limitation of liability
We deliver our work with reasonable skill and care, but we cannot promise that it will be error-free or earn any particular revenue. To the extent the law allows, our total liability for any claim relating to a project is limited to the amount you paid us for that project, and we are not liable for indirect or consequential losses.
9. Confidentiality
We keep your project details and materials confidential and use them only to do the work. We may mention that a project was delivered, without revealing confidential details, unless you ask us not to.
10. Changes and governing law
We may update these terms and will change the date above when we do. Projects already quoted keep the terms they were quoted under. The laws of the country in which Shivom is registered govern these terms.
